Whelton Hiutin LLP was recently successful in responding to an application for leave to appeal to the Supreme Court of Canada in Chen v. Brookfield Residential (Ontario) Limited, a case concerning the purported rescission of an agreement of purchase and sale under the disclosure statement provisions of the Condominium Act, 1998. Whelton Hiutin LLP lawyers Neil Wilson and Roshni Khemraj were also counsel in the underlying appeal before the Ontario Court of Appeal, in which the Court of Appeal concluded that a notice of rescission that is not provided in good faith does not qualify as a valid notice under the Act.
