Whelton Hiutin LLP senior paralegal Brian Kirkland recently obtained a favourable decision from the License Appeal Tribunal for an injured cyclist whose treatment plan had been denied by his accident benefits insurer. The Tribunal preferred the evidence of the applicant’s treating therapist over the evidence of three medical assessors hired by the insurer because the applicant’s therapist “has more intimate knowledge about the applicant’s treatment needs than the various section 44 assessors do.” A copy of the decision can be found here.
