Whelton Hiutin LLP lawyer Daniel McConville was recently successfully in voiding a signed release in a mortgage case. Whelton Hiutin acted for a mortgagor on a threshold motion prior to trial regarding the validity of a signed release. The mortgagor had signed the release in favour of several mortgagees and related parties. The court declared the release void as an unconscionable transaction, and as part of an unconscionable mortgage scheme, notwithstanding independent legal advice. A copy of the decision, Gold v.
