Neil is a partner at Whelton Hiutin LLP. He practices in the areas of civil and commercial litigation, personal injury and administrative law. Neil represents clients in a broad range of matters including corporate, real estate and employment disputes. He also acts for victims of serious personal injuries. Whatever the case, Neil believes that the key to a successful result is strong, principled and intelligent representation.
Neil has argued cases at all levels of court in Ontario and has experience conducting trials, appeals and motions, including injunctions and summary judgment motions. He has acted as lead counsel on numerous significant appeals. Neil’s approach to litigation is both exacting and practical: he combines dedication to excellence in advocacy with a recognition that the law should not be overcomplicated. He is genuinely enthusiastic about his work and is not afraid to tackle novel or difficult cases.
Neil is a regular writer and presenter on issues concerning civil litigation and access to justice. He has written for a variety of publications including the Advocates’ Journal, the Toronto Star and the Supreme Court Law Review. His articles have been cited by a number of courts across Canada. Neil is also a committed coach and mentor both inside and outside the firm.
Neil graduated from Osgoode Hall Law School where he participated in the intensive program at Parkdale Community Legal Services. He joined Whelton Hiutin in 2011 after completing a judicial clerkship at the Federal Court with the Honourable Justice Russel W. Zinn.

Successful constitutional challenge to driver licensing regulations barring monocular (one-eyed) drivers from being considered for a license to drive a bus, brought under s. 15 of the Charter (equality rights).
- Fortress Carlyle Peter St. Inc. v. Ricki’s Construction and Painting Inc., 2019 ONCA 866
Successfully resisted an appeal of an order granting specific performance of an agreement of purchase and sale for condominium development lands in the Entertainment District.
- Raki Holdings Inc. v. Lionheart Enterprises Inc., 2019 ONCA 786
Successfully acted on an appeal involving the interpretation of a contract for the sale of development lands in which the parties' competing positions resulted in a purchase price difference of over $4,000,000.

Successfully acted on an appeal concerning a failed real estate closing and the disclosure provisions of the Condominium Act.
