Whelton Hiutin LLP lawyers Maureen Whelton and Neil Wilson recently successful resisted an appeal of a judgment granting specific performance of an agreement of purchase and sale for condominium development lands in the Entertainment District. Specific performance was upheld despite late closing funds on the basis of the vendor’s lack of good faith. A copy of the decision, Fortress Carlyle Peter St. Inc. v. Ricki’s Construction and Painting Inc., 2019 ONCA 866, can be found here.
