Whelton Hiutin LLP lawyers Maureen Whelton and Arlene Campbell were recently successful on an urgent hearing to remove a caution registered on title to a residential condominium. The case, Perano Residences Ltd. v. Shah, involved purchasers who entered into an agreement of purchase and sale for a pre-construction condominium and failed to close. The vendor terminated the agreement and resold the property. The day before the resale was to close the purchasers registered a caution on title to the property, frustrating the resale. The court found that the purchasers had no legal right to register the caution and ordered it removed from title. A copy of the decision can be found here.
